Essential Operation Service User Agreement
1.Terms of Acceptance
1.This Agreement is the service agreement (the "Agreement") between Nanjing Inossem Software Technology Co., Ltd. (hereinafter referred to as "Inossem") and the user (hereinafter referred to as "User") of the service platform (Essential Operation) provided by Inossem (hereinafter referred to as "Essential Operation Service" or "Essential Operation Software").
2.Inossem hereby specially reminds that users must carefully read all the terms of this Agreement before using the Essential Operation Service (minors should be accompanied by their guardians when reading this Agreement), particularly all the terms of exempt, reduce or limit Inossem's liability and the term that contain contents which limit users' rights.
3.Users to download and register, login, use and connection Essential Operation services behavior will be regarded as users fully understand, accept and agree to abide by all the content under this agreement. This Agreement may be unilaterally modified by Inossem at any time. Once the revised terms of this Agreement published by Inossem, it shall supersede the original terms of this Agreement and constitute the entire and up-to-date agreement between User and Inossem on the subject matter of this Agreement. Users can review the latest terms and conditions of the agreement at any time on Inossem's website or in the Essential Operation app. If you do not accept Inossem's revised terms and conditions, please stop using Essential Operation service immediately. If the user chooses to continue to use the services of Essential Operation, the user shall be deemed to have fully understood, accepted and agreed to abide by the terms and conditions of the latest agreement as amended by Inossem.
4.User hereby represents that it has fully understood the relevant content of this Agreement and does not have any material misunderstanding; At the same time, there is no obvious unfairness in the content of the agreement.
2.User qualification
Users must have full civil capacity of conduct to access or use Essential Operation Services in various ways. By accessing the Service and accepting the Terms of Use, the User represents and warrants to Inossem that the User has full civil capacity of conduct in accordance with the laws of China and that the User has the right and ability to agree to and abide by such Terms. Users also represents and warrants to Inossem that it will use the Essential Operation Services in compliance with all applicable laws and regulations.
3.Software download and update
1.Software Download
Users can directly download Essential Operation software from Inossem’s website (www.inossem.com) (IOS users can download Essential Operation software directly from Apple App Store ), if the user download Essential Operation software from third party without authorization of Inossem or software with the same name as the Essential Operation, Inossem cannot guarantee the normal use of the Software and shall not be responsible for any losses caused to users.
2.Software installation
Inossem may have developed different versions of the software for different terminal devices. Users should choose the appropriate version to download and install. After downloading the installer, the user needs to follow the steps prompted by the installer to install it correctly.
3.Software updates
(a) In order to improve user experience and service content, Inossem will constantly strive to develop new software versions and provide software updates to users from time to time (these updates may take the form of software replacement, modification, function enhancement, version upgrade, etc.).
(b) In order to ensure the security and consistency of functions of the Software and the Services, Inossem has the right to update the Software or change or limit the effect of some functions of the Software without special notice to Users.
(c) After the release of the new version of the Software, the old version of the Software may not be usable. Inossem does not guarantee that the old version of the software will continue to be available and the corresponding customer service, please check and download the latest version.
4.User registration and password
1.Users shall submit true, accurate, complete identity and other relevant information reflecting the current situation when registering as Essential Operation Service users, and shall timely update the information after changes. If Inossem suspects that the information is not true, accurate, incomplete or fails to reflect the current situation, Inossem has the right to cancel the account;
2.Users promise not to impersonate others for registration, not to register for others without permission, not to register an account in a way that may lead to misidentification by other users, and not to register with a user name that may infringe upon the rights and interests of others (including but not limited to suspected infringement of trademark rights and reputation rights), otherwise Inossem has the right to cancel the account;
3.Users understand and agree that the right to use the Essential Operation Service Account only belongs to the original applicant and shall not be transferred or provided to others in any way, otherwise, Inossem has the right to immediately withdraw the account without notice;
4.Upon successful registration, Inossem will confirm the identity of the user according to the account number and password. The user shall keep the account and password properly, and shall be fully responsible for all activities using the account and password. Users promise to contact us in the event of unauthorized use of their password or account, or any other security issue, through the methods specified in clause 9. The User agrees and acknowledges that Inossem do not have any direct or indirect responsibility for the loss or damage.
5.The user understands and agrees that, if the user does not log in for a long time after registering the Essential Operation service account, Inossemhas the right to recycle the account for the purpose of optimizing the management of the platform, and the relevant problems and responsibilities shall be borne by the users themselves;
6.Inossem shall have the right to dispose the content and information related to the account by means of including but not limited to deletion and shall not assume any liability to the user for such withdrawal or cancellation of the account according to this Agreement.
5.Terms of User Information
1.User's personal information. The user's personal information includes the following information: the user's real name, occupation, profile picture, mobile phone number and IP address.
2.Non-user personal information. User's operation status, usage record and usage habit of Essential Operation Service reflected in Inossem's server and all other information outside the scope of the user's personal information mentioned in paragraph 1 of this article are general information and do not belong to the user's personal information.
3.Third-party platforms record information. Users through sina weibo accounts, QQ account and other third-party platform accounts (hereinafter referred to as the "third party platform) register, login, using Essential Operation services, will be deemed to be the user fully understand, agree to and accept Inossem including but not limited to collect, statistics, analysis and other ways to use the sina weibo, QQ and other third-party platform to fill out, registration, report, record all the information (hereinafter referred to as" the third party platform to record information "). Once a user registers, logs in or uses the services of Essential Operation using the account of a third party platform, any use of the information recorded by Inossem on such third party platform will be deemed to have obtained the full consent and acceptance of the user.
4.Important Note: In order to provide Essential Operation Services to customers, Inossem may reasonably use users' personal information, non-users' personal information and third-party platform recorded information (hereinafter collectively referred to as "User Information"). Once a user registers, logs in or uses the Essential Operation Services, it shall be deemed that the user fully understands, agrees and accepts Inossem's reasonable use of the user information through methods including but not limited to collection, statistics, analysis and use.
5.Purpose, method and scope of the use of the user's personal information. User warrants that it has fully understood that: Inossem uses user information for the following purposes: to provide users with various functions of Essential Operation services, including friendly management, friendly map, project job matching and relationship chain; Inossem's use of User Information includes but is not limited to: collection, statistics, analysis and use for commercial purposes; The scope of Inossem's use of user information includes but is not limited to: personal information of users, non-users' personal information, and information recorded by third-party platforms as defined in paragraph 1, 2 and 3 of this article.
6.Channels for users to inquire, correct and add information. Users can query, correct and add the user information through the relevant functions of "My Information" in Essential Operation Service.
7.Ways and consequences of users refusing to provide information. Users can no longer provide user information to Inossem by discontinuing their use of Essential Operation Services. However, Inossem shall not undertake the responsibility to delete or destroy the user information that the User has previously agreed to use. If the user refuses to provide the user information, Inossem may stop providing Essential Operation Service at any time.
8.Special authorization
(a) If User breaches this Agreement or other agreements entered into with Inossem or Essential Operation Services, Inossem or Essential Operation Services shall have the right to suspend or terminate the provision of all or part of the Services to User and to publicize the breach situation of User on any website operated or actually controlled by Inossem.
(b) Similarly, if a User makes any form of commitment to Inossem or Essential Operation, and Inossem or Essential Operation confirms that the User has breached such commitment, Inossem or Essential Operation shall have the right to immediately impose restrictions on the User's account in the manner agreed by the User's commitment, including but not limited to suspending or terminating the provision of the Service to the User and publicizing the breach of the User. User understands and agrees that Inossem or Essential Operation Services do not need to check the facts with the user or obtain the consent of the user in respect of such confirmation, and that Inossem or Essential Operation Services shall not be liable to the user for any restriction or disclosure.
(c) the user agrees with Essential Operation service for the users to upload data and information, Inossem will be in accordance with the "Essential Operation service user agreement" to protect the data for the user agrees to grant Essential Operation services around the world with a free, permanent, irrevocable, non exclusive licensing rights, and is entitled to at multiple levels of the right to license), or Essential Operation service shall have the right to make Inossem (in whole or in part) use, copy, revision, rewriting, distribution, translation, distribution, execution, and display such content or its derivative works, And/or incorporating such content into other works in any form, medium or technology now known or developed at a later date;
8.It is specially prohibited to use
1.Job Posting, Essential Operation service resume database and other functions of Essential Operation service can only be used for the legitimate purpose of finding project and career information and recruiting consultants for enterprises or project demanders. The personal information provided by Essential Operation Services can only be used for the legitimate purpose of personal and professional communication between individuals and others.
2.Inossem expressly prohibits any other form of use of Essential Operation's services, and all users agree not to engage in any of the following activities:
a) Post positions for Essential Operation Service competitors in Essential Operation Software or include links to or information from any websites competing with Essential Operation Service in the posts and other content;
b) Posts or content posted in the software contain hyperlinks, "hidden" keywords and keywords that are not related to the job title or are otherwise misleading;
c) Not for the purpose of recruiting consultants from the enterprise or the project demander, including but not limited to selling or promoting any products or services with the resume information of Essential Operation Services;
d) Publish or submit any incomplete or incorrect personal information and information not belonging to oneself in Essential Operation Software;
e) Publish information about franchising, pyramid selling, club membership, distribution or sales agency in Essential Operation Software;
f) Collecting security deposits, deposits or other forms of recruitment fees from job seekers;
g) Sending unsolicited letters or emails, unsolicited phone calls or faxes to other users of Essential Operation Services to promote or advertise products and services;
h) Delete or modify information posted by other personal or corporate users;
i) Imposing unreasonably or disproportionately heavy loads on the infrastructure of the Essential Operation service;
j) Use or attempt to use any search engine, software, tool, agent or other device or mechanism not owned or authorized by Inossem or Essential Operation to browse or search the content of the Essential Operation Service;
k) Decipher, decompile, disassemble or reverse engineer any of Inossem's software or components;
l) Summarize, copy or otherwise reproduce in any way any Essential Operation Service content or Inossem Website information without the formal written consent of Inossem; or
m) Click hijack or link to Essential Operation service content and Essential Operation service website information.
3.Inossem will not monitor all information posted, transmitted or communicated on the Site. If a user finds that some content of the Site violates the Terms of Use, please contact us by terms No.9
9.Notification of infringement of copyright and trademark and violation of use
If users believe that someone has infringed their copyright or trademark rights, uploaded, published or copied their copyrighted or trademarked works in Essential Operation service, or there are illegal uses, please contact us through the following ways:

10.For users who infringe others' copyright or other intellectual property rights, their use of Essential Operation services will be terminated
Inossem respects the intellectual property rights of others and requires its users and partners to respect the intellectual property rights of others. Unauthorized distribution, reproduction, modification or public display of a copyrighted work constitute an infringement of the rights of the copyright owner. As a condition of using Essential Operation Services, users agree not to use any Essential Operation Services to infringe the intellectual property rights of others in any way. Inossem reserves the right, with or without notice, to terminate the account of any user who infringes the copyright or intellectual property rights of others and to prohibit his/her access to the website of the Intelligent Services.
11.Responsibilities of Essential Operation Service
Enterprise or project demand release project opportunities and job seekers to release your resume and personal data as one of the core functions and services, Essential Operation service only in accordance with the law to publish content of screening and examination, including but not limited to personal data provided by job seekers, but Inossem does not participate in the actual transaction between enterprises and job seekers in the call (except the user as a candidate for Inossem ). Therefore, Inossem has no control over the quality, security, and legality of the user's content, the authenticity and accuracy of the posts, or the ability of the company to provide job opportunities to job seekers or the ability of job seekers to fill the job. Inossem does not make any commitment to any job offer or resume in the service of Essential Operation. If Inossem believes that certain user content may create unnecessary liability for the service, damage the brand or public image of Inossem or the service, or cause the service (in whole or in part) to lose the service of ISP or other provider, the service may take the necessary action with respect to the user content.
Essential Operation service provides users with a network platform for information exchange. Inossem will not screen or review users' personal information or content published by users except as required by law. Therefore, Inossem cannot control the authenticity, reliability, integrity and timeliness of the personal information or user content submitted by users on Essential Operation Services, and does not make any commitment to the personal information and user content on Essential Operation Services.
12.Disclaimer Warranty
Inossem does not guarantee any Essential Operation service operation and correct or any Essential Operation services and servers from computer viruses or other harmful mechanism. Inossem is not responsible for the cost of maintenance or replacement of equipment or data as a result of the user's use of any Essential Operation software function or Essential Operation service content. Essential Operation Software and Essential Operation Services are provided to users on an "as is" basis without any form of warranty. Essential Operation Services, does not make any direct or indirect warranties to the fullest extent permitted by law, including warranties of merchantability and fitness for a particular purpose and non-infringement.
13.Disclaimer of Indirect Loss
In any case, Inossem and their suppliers, or any third party mentioned on Essential Operation service web site are not responsible for any damages (including, but not limited to, incidental or consequential damages, loss of profit or loss caused by loss of data or business interruption), whether it is due to the use or cannot use any Essential Operation service content and the software, or whether based on warranty, contract, tort or other legal theory, whether Essential Operation service suggests the possibility of such losses.
14.Links to other websites
Essential Operation service may contain links to third party websites. These links are provided for the convenience of the user, it does not represent Inossem's endorsement of the content of third party websites. Inossem is not responsible for the content of the linked third party sites nor makes any representation as to the accuracy of the content or material on similar third party sites. If the user decides to access links to third-party websites, users need to take a risk on its own.
15.Resale or illegal commercial use is prohibited
Customer undertakes not to resell or transfer any of its rights or obligations under the Terms of Use. Users also promise not to use Essential Operation software or Essential Operation services for any commercial purposes without authorization.
16.Terms and Termination
These Terms of Use are binding of the level of access or use of Essential Operation Service Content. If a User violates these Terms, Inossem shall have the right to seek all legal remedies at its discretion, including but not limited to the removal of user content from Essential Operation Services and the immediate termination of User's registration and ability to access the Essential Operation Website or any other services provided by Essential Operation Services. These Terms are legally binding on the User and Essential Operation Service, and the use of Essential Operation Service indicates that the User agrees to accept the Terms of Use. Enterprise users may need to sign a sales contract with Essential Operation Service separately. If there is any inconsistency between this agreement and the sales contract, the sales contract shall prevail.
17.Applicable Law and Dispute Resolution
1.The establishment, effectiveness, performance, interpretation and any dispute arising from this Agreement shall be governed by the laws of the People's Republic of China (excluding the laws of Hong Kong, Macao and Taiwan).
2.Any dispute between User and Inossem in connection with this Agreement shall first be settled through friendly consultation. If no agreement can be reached through consultation within thirty (30) days after the occurrence of such dispute, User hereby fully and irrevocably agrees to submit such dispute to the people's court in the place where Nanjing Inossem Software Technology Co., Ltd. is located for litigation.
18.General Provisions
These terms are governed by the laws of the People's Republic of China. Only courts of competent jurisdiction in China may determine any claim arising under this Agreement. If any court of competent jurisdiction determines that any provision of these Terms of Use is invalid, the invalidity of such provision shall not affect the validity of the other provisions of these Terms of Use, which shall remain fully enforceable and effective. Furthermore, Inossem's failure to enforce any provision of these Terms shall not be construed as a waiver of Inossem's right to enforce these Terms or affect Inossem's or Essential Operation's rights to enforce these Terms in any future circumstances.
19.Additional Terms
Certain areas of Essential Operation Services are subject to additional terms and conditions, and by using these areas, or any part thereof, User agrees to use these areas subject to the applicable additional terms and conditions. These additional terms may be updated from time to time.
20.Other provisions
1.If any provision hereof is invalid or unenforceable in whole or in part for any reason, it shall not affect the validity of other provisions hereof.
